This notice describes how information about the registered member/user may be collected, used and disclosed. Please review it carefully. This web site is updated by each member for the use of all the members. So any information listed on this web-site will be published one way or the other for community use.
1) Registered member of Kapol.org understands and accepts that the Kapol.org collects personally identifiable data such as name, addresses, telephone number, e-mail addresses and other unique identifier etc. that are submitted by a registered member when he/she wishes to become a registered member/user of the services provided.
2) Personally identifying information provided by you will be used in connection with programs and services or for such other purposes as are described at the point of collection. One of the reasons to collect information from users registering on Kapol.org is to customize the services at Kapol.org. Information may also be collected during contests and when certain services at Kapol.org are accessed for the first time. This is done only when the information previously collected is inadequate.
3) We may enable cookies to customize the services provided to the user. A "cookie" is a file placed on your personal computer's hard drive by a Web site that allows it to monitor your use of the site. 7) Information provided by all Users needs to be true, accurate, current and complete as required by the registration form and to be updated promptly, to keep it true, accurate, current and complete.
8) All the contents & information provided by a user will be available on the website to all the registered user of Kapol.org in various report formats. Kapol Samaj of North America does not sell, or publish the member’s information to third party.

(Membership Agreement)
This is a legal agreement ("Agreement") between you and KAPOL SAMAJ OF NORTH AMERICA (“KSNA”).
Please read the Agreement carefully before registering for KAPOL.org service. By registering on KAPOL.org, you become a member of this Service (a "Member"), and you agree to be bound by all the terms and conditions of this Agreement (the "Terms") for as long as you continue to be a Member. IF YOU DO NOT AGREE TO THE TERMS & CONDITIONS, PLEASE DO NOT REGISTER FOR KAPOL.org SERVICE.
1. General: - This site is owned and operated by KSNA, New Jersey, USA.
2. KSNA reserves all rights to change or discontinue any aspect or feature of the above said site at any time including the contents, hours of availability and equipment needed for access or use of the site. These terms of use apply to all users, visitors, advertisers and members of KAPOL.org.
THIS SERVICE IS FOR ADULTS (Age 18 and above) ONLY. KAPOL.org IS NOT INVOLVED IN ANY ACTUAL INTERACTION BETWEEN MEMBERS OR VISITORS AND IS NOT AN AGENT OF ANY PARTY FOR ANY PURPOSE. AS A RESULT, WE HAVE NO CONTROL OVER THE QUALITY, SAFETY OR LEGALITY OF THE PROFILES PUBLISHED, THE TRUTH OR ACCURACY OF THE LISTINGS.
The KAPOL.org service (".org" or the "Service", provided by KSNA) is for your sole, personal use. You will not be able to authorize others to use your membership, and not be able to assign or otherwise transfer your account in any manner to any other person or entity.
The Registered member of Kapol.org understands and accepts that the provided information will be available to the other registered member/user of Kapol.org. Also the registered member/user accepts that the information provided here are for general community information use and not to solicit any business directly or indirectly or to provide the listing to unauthorized or third party.
3. Online Conduct. As a Member, you agree that:
You are solely responsible for the contents or information you publish or
display (hereinafter, "post") on KAPOL.org service, or transmit to other KAPOL.org members through contacting, e-mail, or the forums or in any manner.
You will not post on KAPOL.org service, or transmit to other KAPOL.org members or employees, any defamatory, inaccurate, abusive, obscene, profane, offensive sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party's rights.
You will not include in your profile any offensive anatomical or sexual references, offensive sexually suggestive or connotative language, URLs, E-mail addresses and you will not post any photos containing nudity, unauthorized personal information, cartoons, or photos which are not of you.
KSNA reserves the right to edit, delete, hide or reject any profile or photo that does not comply with these terms or comply with the KAPOL.org profile standards.
You grant KSNA all rights to edit, copy, display, add, publish and distribute any material made available on the site by you.
Foregoing provisions are for the benefit of KSNA, its subsidiaries, affiliates and its third party content providers and licensors only.
4. Disclaimer of Warranty; Limitation of Liability:
A. YOU EXPRESSLY AGREE THAT USE OF THE SITE IS AT YOUR SOLE RISK. NEITHER KSNA, ITS AFFILIATES, PARTNERS NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, VOLUNTEERS, THIRD PARTY CONTENT PROVIDERS OR LICENSORS WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION, SERVICE PROVIDED THROUGH THE SITE.

IN NO EVENT WILL KSNA, IT'S AUTHORISED PERSON, REPRESENTATIVE, VOLUNTEERS, ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING THE SITE OR THE CONTENT INCLUDED THEREIN, BE LIABLE IN CONTRACT, IN TORT OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) FOR ANY DAMAGES, INCLUDING, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL OR SIMILAR DAMAGES, LOSS / PROFITS OR REVENUES, LOSS OF USE OR SIMILAR ECONOMIC LOSS, ARISING OUT OF USE OF OR INABILITY TO USE THE SITE. YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL USE OF AND CONTENT ON THE SITE. E. KSNA DOES NOT WARRANT THAT YOUR USE OF THE KAPOL.org SERVICE WILL BE SECURE, UNINTERRUPTED, ALWAYS AVAILABLE, OR ERROR-FREE, OR WILL MEET YOUR REQUIREMENTS OR THAT ANY DEFECTS IN THE SERVICE WILL BE CORRECTED.
KSNA DOES NOT GUARANTEE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION ON THE SERVICE AND NEITHER ADOPTS NOR ENDORSES, NOR IS RESPONSIBLE FOR ACCURACY OR RELIABILITY OF ANY OPINION, ADVICE, PROFILE LISTING, CONTACT MAIL, OR STATEMENT MADE. UNDER NO CIRCUMSTANCES WILL KSNA BE RESPONSIBLE FOR ANY LOSS OR DAMAGE RESULTING FROM ANYONE'S RELIANCE ON INFORMATION OR OTHER CONTENT POSTED ON THE KAPOL.org SERVICE, OR TRANSMITTED TO KAPOL.org MEMBERS.
F. BECAUSE KAPOL.org IS NOT INVOLVED IN MEMBER TO MEMBER OR MEMBER TO VISITOR INTERACTIONS, IF A DISPUTE ARISES BETWEEN YOU AND ANOTHER MEMBER OR VISITOR, YOU INDEMINIFY AND RELEASE KSNA (AND ITS AGENTS AND EMPLOYEES) FROM CLAIMS, DEMANDS AND DAMAGES (ACTUAL AND CONSEQUENTIAL) OF EVERY KIND AND NATURE, KNOWN AND UNKNOWN, SUSPECTED AND UNSUSPECTED, DISCLOSED AND UNDISCLOSED, ARISING OUT OF OR IN ANY WAY CONNECTED WITH SUCH DISPUTES.
G. By its very nature, other people's information may be offensive, harmful or
in-accurate, and in some cases will be mislabeled or deceptively labeled. We
expect that you will use caution--and common sense--when using this information.
6. Monitoring. KSNA RESERVES THE RIGHT, BUT HAS NO OBLIGATION, TO MONITOR THE MATERIALS POSTED IN THE PUBLIC AREAS OF THE KAPOL.org SERVICE. KSNA SHALL HAVE THE RIGHT TO EDIT OR REMOVE ANY SUCH MATERIAL THAT VIOLATES, OR IS ALLEGED TO VIOLATE, THE LAW, KAPOL.org PROFILE STANDARDS OR THIS AGREEMENT. YOU REMAIN SOLELY RESPONSIBLE FOR THE CONTENT OF THE MATERIALS YOU POST IN THE PUBLIC AREAS OF THE SERVICE AND YOUR PRIVATE E-MAIL MESSAGES. E-MAILS SENT BETWEEN YOU AND OTHER KAPOL.org MEMBERS THAT ARE NOT READILY ACCESSIBLE TO THE GENERAL PUBLIC WILL BE TREATED AS PRIVATE BY KSNA TO THE EXTENT REQUIRED BY APPLICABLE LAW.
7. Indemnification. You agree to indemnify and hold harmless KSNA and its respective directors, officers, employees, volunteers and agents and its affiliates from and against any and all claims, actions, demands, damages, costs, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of your use of the KAPOL.org services including any breach by you of the terms of this Agreement.
8. Third Party Content. KSNA is a distributor (and not a publisher) of content supplied by third parties and the member of the site. Accordingly, views expressed in articles, announcement or e-mails by contributors, authors, member, and participants of the "Community" section DO NOT reflect nor represent the views of this web site or it operators. Authors, contributors, and all participants of the "Community" section are not an employee, agent, or representative of KSNA.
9. Complaints. To resolve a complaint /Suggestion regarding KAPOL.org service, you should first contact KSNA Customer Support at info@kapol.org
10. Miscellaneous. This Agreement shall be construed in accordance with laws of the State of New Jersey, USA, without regard to its conflict of laws; rules and you hereby consent to exclusive jurisdiction in the courts of New Jersey for any cause of action, claim, liability, demand or dispute arising out of your use of this site or its Terms of Use. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used herein are for convenience only and shall not be given any legal import. This Agreement, accepted upon registering for the Kapol.org service, contains the entire agreement between you and KSNA regarding the use of the Service. This Agreement may only be amended upon notice by KSNA to you, or by a writing signed by you and an authorized official of KSNA unless otherwise explicitly stated, the Terms will survive termination of your membership to the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
